BerlinWasser International (BWI) is the main candidate in the tender organized by the County Council of Constanta to extend, restructure and privatize the water & sewage utilities through a PPP based on a BOT model. BWI will modernize, manage, operate and maintain the water supply and wastewater collection and treatment systems in the County of Constanta for a period of 20 years, based on a concession agreement to be concluded with the County Council. The total investment in the project will be around EUR 250 million, of which EUR 40-50 million will be the participation of BWI with the rest of the investment to be financed from future cash-flow. SvWP is providing legal assistance with respect to the Romanian legal framework, assistance in preparing the pre-qualification documentation, as well as the tender documents, mainly with respect to the list of investment & investment schedule, commercial operation concept, due diligence of the billing structure, legal & tax, and financial. After the tender SvWP will advice and assist BWI in tax, legal and financial matters, determination of local prices for material and man power, organize customs clearance of plant machinery and materials, applying for all necessary licenses, work permits and all other official documentation, assistance in selecting the most appropriate financing solutions and the conclusion of credit agreements necessary for the Project’s development.
